Terms of service

Last updated 24 October 2026

By creating an account or using SmartMenu you agree to these terms. If you use it for a restaurant, you confirm you are allowed to act for that business.

1. The service

SmartMenu lets restaurants publish menus that guests open by scanning a QR code, with an AI waiter, shared table orders and tools for managing menus. We may add, change or remove features over time.

2. Accounts

Keep your sign-in details safe and tell us if you think someone else has used your account. You are responsible for what happens under your account and for the staff you invite. Give accurate information and keep it up to date.

3. Your content

You own the menus, photos and other content you add. You give us permission to store, process, translate and display it to run the service for you, including sending it to AI providers to produce results.

You are responsible for your content, including prices, descriptions, allergen and dietary information, and for having the rights to what you upload.

4. AI waiter and allergens

The AI waiter answers from your menu, but AI can make mistakes. Answers about ingredients, allergens or diets are guidance only and must never replace your staff. Keep your allergen information accurate, tell guests to confirm allergies with staff, and review conversations and teach the waiter when it gets something wrong.

5. Acceptable use

Do not use the service to break the law, publish misleading or harmful content, infringe others' rights, attack or overload the service, try to access other accounts, or resell it without our agreement. Do not use the AI features to generate abusive content.

6. Plans and payment

The Free plan has no charge. Paid plans are priced per location and per period as shown on our pricing page or agreed with you. Payment is collected directly by us, for example in person or by transfer, and we record it and send a receipt.

When a paid period ends there is a grace period during which paid features keep working. After that the restaurant moves to the Free plan; your data is not deleted. Prices can change for future periods, and we will tell you before they do.

7. Suspension and ending

You can stop using the service at any time and ask us to delete your account. We may suspend or end access if these terms are broken, if payment is overdue after we have contacted you, or to protect the service and other users. We will tell you why when we can.

8. Availability

We work to keep the service running but we do not promise it will always be available or free of errors. We may take it offline for maintenance.

9. Liability

The service is provided as is. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or harm resulting from AI answers or inaccurate menu information, and our total liability for any claim is limited to the amount you paid us in the three months before it. Nothing in these terms limits liability that cannot be limited by law.

10. Changes and contact

We may update these terms. We will change the date above and tell restaurant owners about significant changes. Continuing to use the service after a change means you accept it. These terms are governed by the laws of the country where we are established.
